All bidding is online only through Gold Exchange Universe’s Website.
These terms and conditions apply for all individuals participating in Gold Exchange Universe online auctions. They also apply for all live online bidders unless specifically covered separately under their respective headings. The highest bidder shall, once the respective auction has ended for a particular Lot be the successful purchaser and will be deemed to have entered into a binding contract (subject to the conditions set out below) with the owner of the Lot in its own right or with Gold Exchange Universe as the duly appointed agent of the owner (as the case may be). In the event of any dispute as to the bidding in respect of any Lot, Gold Exchange Universe shall have absolute discretion to settle the dispute as sole arbitrator and his decision shall be final and binding.
Gold Exchange Universe has the right to:
All bidders participating in the online auction will be required to complete a registration form online, upon moving forward to the next step and, MUST be 18 years or older and permitted by law to enter into a legally binding contract. There is no cost incurred to become a registered bidder. This registration form online requires completion of all fields by the bidder who warrants the accuracy of all information provided. Any false or misleading information provided by the bidder when completing the registration form online will not reduce any obligation the Bidder has to Gold Exchange Universe. Photo identification, such as a current driver’s license or valid passport will also be required when completing the registration form online following which the bidder will be presented with an online bidder account displaying a unique bidder number. Upon registering for the auction the Bidder does authorise the Gold Exchange Universe to utilise private and personal information obtained for the delivery of promotional material, compliance with the law, internal and administrative purposes.
The purchaser acknowledges that Gold Exchange Universe acts as the agent of the owner of the Lot or as the owner of the Lot in its own right and as such neither Gold Exchange Universe in either capacity (as the case may be) or the owner of the Lot shall be responsible for any defects or faults in respect of any Lot. All Lots are available to view online on Gold Exchange Universe’s website(s) prior to auction and it is the prospective purchaser’s sole responsibility to inspect and/or enquire about such Lots prior to the commencement of the auction.
As from auction closing all risks in relation to the Lot passes to the successful purchaser notwithstanding that the title to the Lot sold remains with the owner until such time as payment for the Lot has been made in full.
No refunds or exchanges will be given over change of mind after the auction closing and the item won by highest bidder. If however, within 7 days after the auction closing Gold Exchange Universe shall receive from the successful purchaser notice in writing accompanied by the written opinion of a competent expert or authority that the Lot purchased is not as described in the catalogue online represented by Gold Exchange Universe then Gold Exchange Universe will within 7 days of receipt of such notification refund to the successful purchaser the full purchase price paid subject to the return of the Lot purchased in the same condition and state of repair including any certificates, packaging and other materials provided as at the time of the auction closing and subject further to Gold Exchange Universe being satisfied as to the validity of the claim.
All bids are deemed to be inclusive of GST (where applicable) or any other value added tax or goods and services tax. The successful purchaser in addition to payment of the amount of the successful bid will also be responsible for payment of a buyer’s premium of 15%. Payment is to be made by cash, Visa, MasterCard & American Express or any other payment method accepted by Gold Exchange Universe.
Each Lot shall be paid for and removed at the expense of the successful purchaser, on the day that the sale takes place, or at the sole discretion of Gold Exchange Universe a deposit of 10% will be accepted by Gold Exchange Universe and must be paid by the successful purchaser on the day of sale and the balance due and owing must be paid to Gold Exchange Universe and the Lots removed within the number of days following the auction as shall be nominated by Gold Exchange Universe, generally a week from the auction. Failure of the successful purchaser to comply with this condition will be deemed a breach of the Contract whereupon Gold Exchange Universe will be entitled to forfeit any deposit paid and to terminate the Contract.
Maximum bids is the maximum amount you are willing to pay for the Lot in question. Your bid is entered online on the Gold Exchange Universe auction platform and executed on your behalf using up the amount required to knock out any competition during the sale and against any reserve price (if applicable). This doesn’t mean that you will pay the maximum amount; if the auction activity is at a lower level on the day you may get the item for less. If online auction bids go above the maximum bid, then your maximum bid placed is unsuccessful.
You will be able to place an online bid on an item through the website, however the online bidding will close prior to the commencement of the live auction registered start timeframe. This means you may be outbid at the live auction.
How it works:
Presale bidding enables competitive bidding in real time prior to the commencement of the live auction. Offering customers the opportunity to bid online up until the night before on a live online auction. Bidders are able to see the highest current bid through our website catalogue and also receive ‘outbid notifications’ by email. When the presale bidding closes the highest bids are carried through into the live online auction. Please remember that the bids placed for presale bidding are real time bids which cannot be amended or retracted bids.
For online bidding, clients must register or sign in, providing credit card details. Registration will also enable you to request information about a ‘Lot’.

If the purchaser fails to pay as herein provided, the purchaser shall remain liable for the amount of the successful bid plus the buyer’s premium, until such payment is made in full, any deposit will be forfeited. Upon full settlement of the Lot, purchasers may collect their purchases at Gold Exchange Universe’s head office location with prior arrangement scheduled to collect them in place or arrange to have them shipped to a destination of the purchaser’s choice. The party named on the online registration form/online account shall be deemed to be the purchaser unless Gold Exchange Universe is prior to the commencement of the auction provided with written evidence that the party is acting for and on behalf of a principal and shall supply the full name and address of the principal.
Auction closing means such time as a purchaser has bid for a particular Lot and Gold Exchange Universe has acknowledged that purchaser as being the successful purchaser at which time a binding contract subject to these terms and conditions has been entered into. Gold Exchange Universe means Gold Exchange Universe Pty Ltd ABN 76 165 775 155 trading Gold Exchange Universe and any of its associated and subsidiary companies and entities or their duly appointed employees, servants and agents. Lot means any lot or lots for sale either individually or as a group at Gold Exchange Universe’s sole discretion.
Each Lot in the online catalogue is given a low and high auction estimate representing that range which, in the opinion of Gold Exchange Universe, represents a fair and probable auction value. When possible, the estimate is based on previous auction records of comparable property, condition, rarity & quality. The estimates are often determined several weeks before an auction and are therefore subject to change upon further research of the item, or to reflect market conditions or currency fluctuations. Estimates are subject to revision. Actual prices realised for items can fall below or above this range. An estimate of the selling price should not be relied on as a statement that this is the price at which the item will sell or its value for any other purpose.
If for any cause a purchased Lot cannot be delivered in as good condition as at the time of sale, or should any purchased Lot be stolen or undelivered or lost prior to delivery, Gold Exchange Universe shall not be liable for any amount in excess of that paid by the purchaser.
The purchaser agrees that these Terms and Conditions and any claim and any dispute between Gold Exchange Universe, purchaser or any other relevant party, shall be construed by the laws of the country in which the auction takes place, unless otherwise expressly nominated by Gold Exchange Universe in its sole discretion.
The provisions contained in each Clause of these Conditions of Sale, and any part thereof, shall be enforceable independently of the remainder of these Conditions of Sale and its validity shall not be affected if any other part is invalid to any extent.

The Site allows you to, among other things use your computer or mobile device(s) to place bids and monitor live auctions (collectively, the “Services”). We are the owner of any information collected through the Site. This Privacy Policy is only applicable when users access the Site and may not be applicable to information collected by Us in other channels (for example, valuation services, subscriptions to catalogues, transactions, etc.). We share your information with the Processors, and by conducting a transaction using the Application, you consent to that sharing. This policy covers only information shared with Us.
Gold Exchange Universe collect and store information that you voluntarily provide to us as well as data related to your use of the Site.
When you register with Us and use the Services, we ask that you provide your name, email address, user name and password. You can also choose to provide us with additional information, such as a contact phone number. All of the information listed in this paragraph is collectively referred to as your “Personal Data”. This Personal Data is necessary to provide you with the Application and we are processing this Personal Data in accordance with your request.
If you choose to purchase an item at auction, your payment information is processed by a third party payment processor. Please carefully read the section titled “Processing Payments for Auction Items” below. All payment information is necessary to process for the purpose of completing the transaction that you have requested with Us.
The Application can also provide you with push notifications of upcoming events, such as sales or auctions. You can opt out of receiving push notifications at any time by using the settings on your mobile device. You can stop all collection of information by the Application by uninstalling the Application. You may use the standard uninstall processes as may be available as part of your mobile device or via the mobile application marketplace or network.
In addition, we automatically collect certain information and analytical data related to your use of the Site and Application (“Usage Information”). In the aggregate, this Usage Information is non-personally identifiable or anonymous information about you, including the date and time of your visit, the phone network associated with your mobile device, your mobile device’s operating system or platform, the type of mobile device you use, your mobile device’s unique device ID, location and the features of our Application you accessed (collectively “Aggregate Information”).
This Aggregate Information is in no way associated with your Personal Data. Usage Information is necessary for the operation and optimisation of the Site and the Application.

Processors use third-party credit card processors to process payments for auction items that you choose to make through the Services. To make this possible, your name, billing address and order total are shared via secure (encrypted) means with our third-party payment processors for the sole purpose of completing your order. Please note that your credit card information (number, expiration date, security code) is stored by the third party payment processor and not us, nor Processors. We have entered into agreements with our payment processors to protect and secure your information. We may disclose Personal Data to our third party service providers to provide you with the Services, including our third party payment processor. We share Aggregate Information with companies that provide public relations and marketing services for us. Such information will only be shared by us to customise, measure and improve our Site, Application and Services.
We may disclose information, including Personal Data, which we believe is appropriate to protect our rights, or to cooperate in investigations of fraud or other illegal or inappropriate activity or in response to a subpoena, court order or other comparable legal process. You are solely responsible for any and all activities that occur under your account or on your mobile device. You may not share your password or Services account with anyone. We will never ask you to send your password or other sensitive information to us in an email, though we may ask you to enter this type of information on the Site or the Application interface. If you believe someone else has obtained access to your password, please change it immediately. The collection of goods applies to the physical auction goods. Buyers are permitted to pay and collect their items with a prior scheduled appointment with Gold Exchange Universe from our head office location and after the auction has finished. Once payment is cleared, a staff member will source out the purchased Lot/s for the buyer. After finalising the purchase, the buyer may leave the premises with their items and receipt of purchase.
Gold Exchange Universe is committed to providing the most effective shipping options so that you get your purchases fast and safe. We will send your items to you by any method you prefer. Multiple items are combined under the same shipment, unless the pieces are gifted and sent to an alternative address.
It is the buyer’s duty to assess any potential costs or fees prior to purchasing items from Gold Exchange Universe. Gold Exchange Universe takes no responsibility for any delays or fees incurred through customs with international shipping.
